This Application Service Agreement (hereinafter referred to as the "Agreement") is entered into by and between the following parties (hereinafter referred to as the "Party A" and "Party B"). Party A owns and operates the KEATH.AI website (hereinafter referred to as the "Website"), and Party B is a user of the services provided by the Website. Before accepting this Agreement, please carefully read all the terms of this Agreement and ensure that you fully understand and agree to the following terms. If you do not agree to any of the following terms, please stop using the Website.
1.1 The services provided by Party A include but are not limited to uploading assignments, AI evaluation of assignments, and other AI evaluation-related features.
1.2 Party B agrees to use the services provided by Party A, abide by this Agreement, and comply with other relevant policies and regulations posted on the Website.
2.1 Party B needs to create a user account to use the services of KEATH.AI. Party B is responsible for the security of their account and is liable for all activities under their account.
2.2 Party B may not share or disclose their account information to third parties or allow any third party to use KEATH.AI services in their name.
3.1 Party B can upload assignments and related materials through KEATH.AI for AI evaluation.
3.2 Party B must ensure that the assignments and materials uploaded do not infringe upon the intellectual property of others and do not contain any illegal, obscene, defamatory, insulting, or inappropriate content.
4.1 Party A will use AI technology to evaluate assignments based on the materials uploaded, and provide evaluation results to Party B.
4.2 Party B understands that AI evaluation may have some degree of error, and Party A does not provide any express or implied warranties regarding the accuracy of evaluation results.
5.1 Party A will take reasonable measures to protect the security and privacy of user data, but is not responsible for any unauthorized access or data breaches.
5.2 Party B agrees that Party A may collect, store, and process their personal data in accordance with this Agreement and the Privacy Policy.
6.1 Party A may charge service fees according to their self-established fee standards.
6.2 Party B must pay the relevant fees as required by Party A. Once the payment is completed, it is non-refundable.
7.1 Party A reserves the right to terminate or suspend Party B's access at any time, including for violations of this Agreement.
7.2 Party B may terminate the use of KEATH.AI services at any time, subject to compliance with the terms of this Agreement.
8.1 The services of KEATH.AI are provided "as is" and without any express or implied warranties.
8.2 Party A is not liable for any direct or indirect losses resulting from Party B's use of KEATH.AI services, including but not limited to data loss, profit loss, or business interruption.
9.1 Party A owns the intellectual property rights related to KEATH.AI and its content.
9.2 Party B may not infringe upon Party A's intellectual property or other legal rights while using KEATH.AI services.
10.1 Party A reserves the right to modify this Agreement at any time. The modified Agreement will be posted on KEATH.AI and will be effective from the date of publication.
10.2 Party B's continued use of KEATH.AI services will be considered an acceptance of the modified Agreement.
11.1 All notices related to this Agreement should be given through publication on KEATH.AI, email, or other suitable means.
12.1 This Agreement is governed by the laws of the United Kingdom.
12.2 In case of disputes arising from this Agreement, Party A and Party B shall attempt to resolve them amicably through negotiations. If negotiations fail to resolve the dispute, both parties agree to submit the dispute to a competent court.
This Agreement constitutes the complete agreement between Party A and Party B regarding the services of KEATH.AI, replacing all prior oral or written agreements. In case of any disputes between the parties regarding this Agreement, the English version shall prevail.
